Terms of Service

Please read Section 17 carefully. It waives your right to a jury trial and your right to participate in a class action, and it requires you to raise a dispute with us informally before filing a claim. It does not force you into arbitration. For most disputes you keep the right to go to court, including small claims court in your own area.

1. Introduction

Welcome to RaspberryPints. These Terms of Service ("Terms") are a binding agreement between you and RaspberryPints, LLC, an Arizona limited liability company ("RaspberryPints," "we," "us," or "our"). They govern your access to and use of the RaspberryPints website, mobile and TV applications, hardware, and services (collectively, the "Services"), and any information, text, graphics, photos or other materials uploaded, downloaded or appearing on the Services (collectively referred to as "Content").

By creating an account, checking the box indicating your agreement, or otherwise accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

2. Basic Terms

You are responsible for your use of the Services, for any Content you post to the Services, and for any consequences thereof. The Content you submit, post, or display may be able to be viewed by other users of the Services and through third-party services and websites. You should only provide Content that you are comfortable sharing with others under these Terms.

You may use the Services only if you can form a binding contract with RaspberryPints and are not a person barred from receiving services under the laws of the United States or other applicable jurisdiction. If you are accepting these Terms and using the Services on behalf of a company, organization, government, or other legal entity, you represent and warrant that you are authorized to do so.

3. Account Creation and Security

To use certain features of our Services, you may be required to create an account. You are responsible for safeguarding your account, and for all activities that occur under your account. RaspberryPints will not be liable for any loss or damage arising from your failure to adequately secure your account credentials.

You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. RaspberryPints reserves the right to suspend or terminate your account if any information provided proves to be inaccurate, not current, or incomplete.

4. License to Use Services

Subject to these Terms, RaspberryPints grants you a personal, worldwide, royalty-free, non-assignable, non-exclusive, revocable, and non-sublicensable license to access and use the Services as provided to you by RaspberryPints. This license is for the sole purpose of enabling you to use and enjoy the benefit of the Services as provided by RaspberryPints, in the manner permitted by these Terms.

The Services and all rights therein are and shall remain RaspberryPints property or the property of RaspberryPints licensors. Neither these Terms nor your use of the Services convey or grant to you any rights:

  • in or related to the Services except for the limited license granted above; or
  • to use or reference in any manner RaspberryPints company names, logos, product and service names, trademarks, service marks or other indicia of ownership.

5. Software Licenses

Any software provided to you as part of the Services is subject to the license terms included with that software. If no license terms are provided, then RaspberryPints grants you a limited, personal, non-exclusive, non-transferable, and revocable license to use the software solely to access the Services. Any rights not expressly granted herein are reserved.

For users who purchase a commercial license for our brewery management software:

  • The license granted is per brewery, per location.
  • The license is non-transferable without RaspberryPints' explicit written consent.
  • Technical support is provided according to the terms of your specific license tier.
  • Redistributing, reverse engineering, modifying, or creating derivative works is prohibited unless explicitly permitted in writing.

6. Hardware (FlowBox) Terms

For customers who purchase RaspberryPints hardware ("FlowBox"):

  • Hardware is sold with a limited warranty as described in our warranty policy.
  • Hardware must be used in accordance with provided specifications and instructions.
  • Firmware updates may be automatically applied to ensure optimal performance and security.
  • Tampering with hardware may void warranties and potentially violate these Terms.
  • RaspberryPints is not responsible for any damages resulting from improper installation or use of hardware.

7. User Content and Conduct

You retain all rights to any Content you submit, post or display on or through the Services. We claim no ownership of it. By submitting Content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, cache, reproduce, adapt (for example to resize or reformat an image), publish, transmit, and display that Content solely for the purpose of operating, providing, securing, and improving the Services for you. This includes displaying your Content on your public taplist, in printable menus you generate, and through embeds and integrations you enable.

This license extends to our service providers (such as our hosting and content delivery providers) only to the extent needed to deliver the Services. We will not use your Content for our own marketing or promotional purposes without your permission, and we will not sell or license your Content to third parties. The license ends when you delete the Content or close your account, except for copies retained in routine backups for a limited period and copies others have already downloaded or cached from your public taplist, which we cannot recall.

You represent and warrant that you have, or have obtained, all rights, licenses, consents, permissions, power and/or authority necessary to grant the rights granted herein for any Content that you submit, post or display on or through the Services. You agree that such Content will not contain material subject to copyright or other proprietary rights, unless you have necessary permission or are otherwise legally entitled to post the material and to grant RaspberryPints the license described above.

You are responsible for your use of the Services, for any Content you provide, and for any consequences thereof, including the use of your Content by other users and third-party services. You agree not to post Content that:

  • Violates any applicable law or regulation
  • Is harmful, abusive, unlawful, threatening, harassing, defamatory, or invasive of another's privacy
  • Infringes any intellectual property or other rights of any entity or person
  • Constitutes unsolicited bulk messaging ("spam")
  • Contains software viruses or any other computer code designed to interrupt, destroy, or limit the functionality of computer software or hardware
  • Constitutes unauthorized or unsolicited advertising, promotional materials, or any other form of solicitation

Image Uploads and Public Hosting

Certain features of the Services allow you to upload images (such as brewery logos, beer label artwork, photos, and similar media). You understand and agree that images you upload are stored on our servers and made publicly accessible at a public URL on the domain images.raspberrypints.com (or any successor domain). Such images are not access-controlled and can be viewed, accessed, downloaded, and cached by anyone who has or can discover the URL. You should not upload any image that you do not wish to be publicly available.

By uploading an image, you represent and warrant that you own all rights to that image, or have otherwise obtained all rights, licenses, consents, and permissions necessary to upload it and to have it publicly hosted, displayed, and distributed through the Services, and that the image does not infringe the copyright, trademark, privacy, publicity, or other rights of any third party, and does not violate any applicable law.

You are solely responsible for the images you upload. RaspberryPints does not pre-screen all uploaded images and is not responsible for their content. If we receive a copyright or other intellectual property complaint or takedown notice, or otherwise determine in our sole discretion that an uploaded image may infringe the rights of a third party, violate these Terms, or violate any applicable law, we reserve the right to remove, disable access to, or permanently delete that image from our servers at any time, with or without notice to you. We may also suspend or terminate the account of any user who repeatedly uploads infringing or otherwise prohibited content.

Automated Content Screening

Images you upload are screened automatically by a third-party image analysis service (currently Amazon Rekognition) before they are published. The screening looks for explicit nudity, sexual content, graphic violence, and hate symbols. If an image is flagged, the upload is rejected automatically and no human reviews it beforehand. Automated screening is imperfect and may occasionally reject an image that does not actually violate these Terms.

If you believe an image was rejected in error, you may request human review by contacting support@raspberrypints.com. We will review the decision and, if we agree the image is permitted, allow the upload. Automated screening is a content-moderation control only. It is not used to make decisions about your account, your billing, your pricing, or your eligibility for any feature.

Copyright Complaints

If you believe content on the Services infringes your copyright, our notice and takedown process, our designated copyright agent, and our counter-notice procedure are described in our DMCA Policy. We terminate the accounts of repeat infringers in appropriate circumstances.

8. API Terms of Use

The RaspberryPints Partner API ("API") allows authorized users to programmatically access and manage brewery data. By using the API, you agree to the following additional terms:

  • API access requires a valid API key issued through the admin panel. API keys are confidential and must not be shared, published, or embedded in client-side code.
  • You are responsible for all activity that occurs using your API keys. If you believe a key has been compromised, you must revoke it immediately.
  • API usage is subject to rate limits and quotas as described in our API documentation. Exceeding these limits may result in temporary or permanent suspension of API access.
  • You may not use the API to scrape, harvest, or collect data in bulk for purposes unrelated to managing your own brewery operations.
  • You may not use the API to build a product or service that competes with RaspberryPints.
  • You may not resell, redistribute, or sublicense access to the API or data obtained through it.
  • RaspberryPints may modify, deprecate, or discontinue API endpoints at any time with reasonable notice. We will endeavor to provide at least 30 days' notice for breaking changes.
  • RaspberryPints reserves the right to revoke any API key at any time, for any reason, with or without notice.
  • The API is provided "as is" without any guarantees of uptime, availability, or response time. RaspberryPints does not offer a Service Level Agreement (SLA) for API availability.

9. Acceptable Use

You agree not to misuse the Services or help anyone else do so. In addition to the restrictions in Section 7, you agree not to:

  • Attempt to gain unauthorized access to any part of the Services, other accounts, computer systems, or networks connected to the Services
  • Use the Services in any manner that could disable, overburden, damage, or impair the Services or interfere with any other party's use of the Services
  • Use any automated means, including bots, scrapers, or scripts, to access the Services except through the API in accordance with Section 8
  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Services
  • Use the Services to store or transmit malicious code, or to conduct any form of network attack
  • Use the Services for any illegal purpose or in violation of any applicable laws or regulations

RaspberryPints reserves the right to investigate and take appropriate action against anyone who, in RaspberryPints' sole discretion, violates this section, including without limitation, removing Content, suspending or terminating accounts, and reporting to law enforcement authorities.

10. Product Analytics in the Admin Panel

To diagnose friction points, identify usability issues, and improve the Services, RaspberryPints uses third-party product analytics and session replay technology (currently Fullstory) within the brewery admin panel and related authenticated areas (the "Admin Areas"). This is a necessary part of the Services and cannot be disabled while using the Admin Areas.

While you use the Admin Areas, we collect and process information about how you interact with the Services, including (but not limited to) page views, clicks, scrolls, navigation, form interactions, browser metadata, device characteristics, IP-derived location, and visual recordings of your in-product activity. Sensitive fields such as passwords and payment details are masked. Recordings are tied to your user account so we can correlate behavior with support requests and improve features specific to your tier and usage patterns.

By accessing the Admin Areas you acknowledge and agree to this collection. If you do not agree, you must not access the Admin Areas. This product analytics processing is independent of the marketing-site cookie preferences described in our Cookie Policy; the Cookie Policy continues to govern analytics on the marketing site (raspberrypints.com), where collection is opt-in.

RaspberryPints does not sell this data and does not use it for advertising. Retention periods for recordings and event data are stated in our Privacy Policy, and all associated data is deleted when your account is terminated. You may request deletion of analytics data associated with your account at any time, or ask us to exclude your account from session recording entirely, by emailing privacy@raspberrypints.com.

11. Third-Party Integrations

The Services may allow you to connect with or use third-party services, applications, or tools (including through the API). RaspberryPints does not endorse, control, or assume responsibility for any third-party services. Your use of third-party services is at your own risk and subject to the terms and conditions of those third parties.

RaspberryPints shall not be liable for any damages, losses, or issues arising from your use of third-party integrations, including but not limited to data loss, service interruptions, or security vulnerabilities introduced by third-party tools.

12. Payment Terms

Certain aspects of the Services, such as commercial licenses, hardware purchases, and premium features, may require payment. When you purchase such items:

  • You agree to pay all applicable fees for your purchases.
  • Your subscription automatically renews at the selected monthly or yearly billing interval until you cancel. You may cancel at any time through Account then Billing. Cancellation takes effect at the end of your current paid period, and as long as you cancel before your next billing date, your subscription will not renew and you will not be charged again.
  • Price changes will be notified at least 30 days in advance.
  • Refunds are provided in accordance with our refund policy.
  • Prices exclude applicable taxes, which may be calculated and added based on your billing location.
  • RaspberryPints reserves the right to discontinue specific product offerings with reasonable notice.

By providing a payment method, you authorize us to charge that method for all fees associated with your account. By subscribing, you authorize RaspberryPints LLC to charge your payment method on a recurring basis at the selected monthly or yearly billing interval until you cancel. If your payment cannot be completed, we reserve the right to suspend or terminate your access to paid features.

If you downgrade your subscription tier, features associated with your previous tier will become inaccessible at the end of your current billing period. Data created using premium features (such as API keys, custom layouts, or team member configurations) will be retained but not accessible until you upgrade again. RaspberryPints is not responsible for any disruption to integrations or workflows caused by a voluntary downgrade.

13. Termination

RaspberryPints may suspend or terminate your access to all or part of the Services at any time, with or without cause, with or without notice, effective immediately. If you wish to terminate your account, you may simply discontinue using the Services or contact our support team for account deletion.

Upon termination, your right to use the Services will immediately cease. You may request an export of your brewery data (beers, taps, and taplist configurations) within 30 days of termination by contacting support. After 30 days, RaspberryPints reserves the right to permanently delete all data associated with your account. Any active API keys will be immediately revoked upon termination.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

14. Disclaimers and Limitations of Liability

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. RASPBERRYPINTS DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICES OR THE SERVERS THAT MAKE THE SERVICES AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RASPBERRYPINTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; (C) ANY CONTENT OBTAINED FROM THE SERVICES; OR (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

IN NO EVENT SHALL RASPBERRYPINTS'S AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (U.S. $100.00) OR THE AMOUNT YOU PAID RASPBERRYPINTS IN THE LAST 12 MONTHS.

15. Indemnification

You agree to defend, indemnify, and hold harmless RaspberryPints, its officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Services, your violation of these Terms, or your violation of any rights of another.

16. Governing Law and Venue

These Terms, and any dispute arising out of or relating to these Terms or the Services, are governed by the laws of the State of Arizona, without regard to its conflict of law provisions.

Except for claims brought in small claims court as described in Section 17.2, you and RaspberryPints agree that the exclusive jurisdiction and venue for any action will be the state and federal courts located in Maricopa County, Arizona. Each party consents to personal jurisdiction in those courts and waives any objection based on inconvenient forum.

If you are a consumer resident in a jurisdiction whose law grants you mandatory protections that cannot be waived by contract, nothing in this Section deprives you of those protections or of the right to bring proceedings in the courts of your country of residence.

17. Dispute Resolution

Please read this Section carefully. It affects your legal rights, including your right to a jury trial and your right to participate in a class action.

17.1 Talk to Us First

Before filing any claim, you agree to first contact us at legal@raspberrypints.com and describe the dispute and the relief you are seeking. We will do the same for any dispute we have with you. Both parties agree to attempt in good faith to resolve the dispute informally for at least 60 days after that notice. This step is a condition precedent to filing a claim, and any applicable limitations period is paused while the parties work through it.

We take this seriously rather than treating it as a formality. Nearly every dispute at our size is a billing question or a misunderstanding, and it costs neither of us anything to fix it directly.

17.2 Small Claims Court

If informal resolution does not work, either party may bring an individual claim in small claims court, in your local jurisdiction or ours, provided the claim qualifies to be heard there. We encourage this route for smaller disputes. It is inexpensive, does not require a lawyer, and is usually faster than any alternative. Nothing in these Terms prevents you from using it.

17.3 Other Claims

Any claim that cannot be brought in small claims court will be resolved in the state or federal courts located in Maricopa County, Arizona, as set out in Section 16.

We do not require you to arbitrate. We considered a mandatory arbitration clause and decided against it: the forum fees would be substantial for a company our size and the process would be slower and less accessible for you than small claims court. If a dispute ever arises where both of us would genuinely prefer arbitration, we can agree to it in writing at that time, but neither party is obligated to.

17.4 Class Action Waiver

YOU AND RASPBERRYPINTS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. No court may consolidate more than one person's claims or preside over any form of class or representative proceeding under these Terms.

If a court decides that this waiver is unenforceable as to a particular claim or request for relief, that claim or request will proceed separately in the courts identified in Section 16, and the waiver will continue to apply to all other claims.

17.5 Jury Trial Waiver

YOU AND RASPBERRYPINTS EACH WAIVE ANY RIGHT TO A JURY TRIAL in any proceeding arising out of or relating to these Terms or the Services.

17.6 Time Limit on Claims

Any claim arising out of or relating to these Terms or the Services must be filed within one year after the claim arose, or it is permanently barred, unless applicable law requires a longer period that cannot be shortened by agreement.

17.7 Changes to This Section

If we make a material change to this Section 17, the change will not apply to any dispute for which we had actual notice before the change took effect, and you may reject the change by emailing legal@raspberrypints.com within 30 days, in which case the version you previously accepted continues to apply to you.

17.8 Survival

This Section 17 survives termination of your account and of these Terms.

18. General Terms

These Terms constitute the entire agreement between you and RaspberryPints regarding your use of the Services, superseding any prior agreements between you and RaspberryPints relating to your use of the Services.

The failure of RaspberryPints to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. In the event that any provision of these Terms is held to be invalid or unenforceable, the remaining provisions of these Terms will remain in full force and effect.

We may modify these Terms from time to time. If we make a material change, we will give you at least 30 days' advance notice by email to the address on your account and by posting a notice in the admin panel, and we will update the "Last Updated" date. Material changes take effect only at the end of that 30-day notice period, and they apply only going forward, never retroactively to a dispute that already exists.

Non-material changes, such as correcting a typo, clarifying existing language, or updating contact details, take effect when posted. Your continued use of the Services after a change takes effect constitutes acceptance of the revised Terms. If you do not agree to a change, you may cancel your subscription before it takes effect, and we will refund any prepaid fees covering the remainder of your current billing period, notwithstanding our usual refund policy.

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of all or substantially all of our assets, on notice to you.

Neither party is liable for any failure or delay in performance caused by events beyond its reasonable control, including acts of God, natural disasters, war, terrorism, labor disputes, governmental action, power or internet failures, or failures of third-party service providers. This does not excuse your obligation to pay amounts owed.

Notices to you will be sent to the email address on your account and are deemed received when sent. Notices to us must be sent to legal@raspberrypints.com.

All trademarks, service marks, logos, trade names, and any other proprietary designations of RaspberryPints used herein are trademarks or registered trademarks of RaspberryPints. Any other trademarks, service marks, logos, trade names, and any other proprietary designations are the trademarks or registered trademarks of their respective owners.
